Terms of Service

By creating an account or using Seafood Market Direct, you agree to these Terms of Service. These Terms constitute a legally binding agreement between you and Seafood Market Direct / Lagniappe IT. If you disagree with any part of these Terms, do not use the site.

Your continued use of the platform after any updates to these Terms constitutes your acceptance of those changes. We recommend reviewing these Terms periodically.

Seafood Market Direct is a public directory connecting seafood buyers with markets, restaurants, wholesalers, and docks along the Gulf Coast and East Coast. The platform is operated by Lagniappe IT, Mandeville, Louisiana, on behalf of the site owner.

Businesses pay for verified listings, which appear with a trust badge and allow them to post official pricing. Price data displayed to the public is community-submitted by registered and anonymous users and is not independently verified by Seafood Market Direct.

The platform is free to browse. No account is required to view the map or read listings. Account registration and listing management features require a valid account.

You must be at least 13 years old to create an account on Seafood Market Direct. By registering, you represent and warrant that you are 13 years of age or older.

If we discover that an account holder is under 13, we will immediately terminate that account and delete all associated personal data from our systems. If you believe a child under 13 has created an account, please contact us at [email protected].

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Do not share your password with others or use another person's account without their permission.

Notify us immediately at [email protected] if you suspect unauthorized access to or use of your account. We will not be liable for any loss or damage arising from unauthorized use of your account where you have failed to keep your credentials secure.

You may submit crowd-sourced price reports to the platform. By submitting any content:

• You grant Seafood Market Direct a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content on the platform
• You represent that your submission is accurate to the best of your knowledge
• You agree not to submit false, misleading, fabricated, or maliciously inaccurate prices
• You agree not to use price submissions to harass, defame, or damage any business
• You agree not to submit spam, promotional content, or coordinated manipulation of price data

You agree not to:

• Submit false, fraudulent, or malicious price reports
• Harass, threaten, or defame any business or individual
• Attempt to access systems, data, or accounts you are not authorized to access
• Scrape, crawl, or automate requests to the platform without prior written permission from Seafood Market Direct
• Create fake accounts or impersonate any person or entity
• Use the platform for any unlawful purpose under applicable local, state, or federal law
• Interfere with or disrupt the technical operation of the site or its underlying infrastructure

We reserve the right to remove, restrict, or flag price reports and other user-generated content that we determine — in our sole discretion — to be false, fraudulent, harassing, defamatory, or otherwise in violation of these Terms.

We further reserve the right to suspend or terminate accounts that repeatedly submit inaccurate or malicious data, that engage in prohibited activities, or that otherwise undermine the integrity of the platform or its community. Businesses with verified listings are also subject to their own listing agreements.

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Seafood Market Direct does not warrant that the platform will be error-free, uninterrupted, secure, or free from viruses or other harmful components. We do not warrant that price data displayed on the platform is accurate, complete, or current.

To the maximum extent permitted by applicable law, Seafood Market Direct and its operators (including Lagniappe IT) shall not be liable for:

• Inaccurate or false community-submitted price data
• Economic loss or purchasing decisions made based on platform data
• Actions of third-party businesses who receive your email address through the platform
• Service interruptions, downtime, or data loss
• Any indirect, incidental, special, exemplary, or consequential damages

In any event, our total aggregate liability to you shall not exceed the greater of $100 USD or the total amount you have paid to Seafood Market Direct in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Seafood Market Direct, Lagniappe IT, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and costs (including reasonable attorneys' fees) arising from or related to: (a) your violation of these Terms; (b) false, fraudulent, or malicious price reports you submit; or (c) your violation of any applicable law or the rights of any third party.

If you are a resident of California, Texas, Florida, New Jersey, Connecticut, Virginia, Delaware, or other states with comprehensive privacy laws, you may have additional rights, including:

• The right to access the personal information we hold about you
• The right to delete your personal information
• The right to correct inaccurate personal information
• The right to opt out of sharing your information with businesses — note that you have expressly consented to this sharing above; you may withdraw that consent by deleting your account

To exercise any of these rights, submit a request to [email protected]. We will respond within 45 calendar days. You will not be penalized or receive degraded service for exercising your privacy rights.

We may suspend or terminate your account for violations of these Terms, fraudulent activity, or repeated submission of false or malicious data. For first-time, non-severe violations, we will provide prior written notice where practicable before taking action.

You may delete your account at any time through your account settings or by contacting us. Upon deletion, we will cease sharing your email address with new businesses. However, businesses that already received your email address may retain it in their own systems, subject to their own privacy obligations and your right to unsubscribe from their communications directly.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.

Any legal action or proceeding arising from or relating to these Terms or your use of the platform shall be brought exclusively in the state or federal courts located in St. Tammany Parish, Louisiana, and you consent to the personal jurisdiction of those courts.

We may update these Terms of Service from time to time. We will notify registered users of any material changes via email or an in-app notice displayed on the platform. The "last updated" date at the top of this page will always reflect the most recent version.

Continued use of the platform after receiving notice of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the platform and may delete your account.
